ROLE OF BROKER: RE-BUY EQUIPMENT ENTERPRISES LLC acts solely as an intermediary broker connecting potential buyers with third-party sellers of used equipment. RE-BUY EQUIPMENT ENTERPRISES LLC does not own, possess, inspect, or take title to any equipment listed through its service. All transactions are directly between the buyer and the seller.
"AS IS" / "WHERE IS" BASIS: All equipment listed through RE-BUY EQUIPMENT ENTERPRISES LLC is offered by the seller on an "AS IS" and "WHERE IS" basis, with all faults known and unknown, unless expressly stated otherwise in a written agreement directly between the buyer and seller.
NO WARRANTIES: RE-BUY EQUIPMENT ENTERPRISES LLC makes NO WARRANTIES OR REPRESENTATIONS WHATSOEVER, EXPRESS OR IMPLIED, regarding any equipment listed, including but not limited to its condition, description, ownership, liens, functionality, safety, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. New Equipment & Manufacturer's Warranty Disclaimer
EQUIPMENT STATUS: The equipment purchased from RE-BUY EQUIPMENT ENTERPRISES LLC is sold in new condition.
MANUFACTURER'S WARRANTY ONLY: This equipment may come with a limited warranty provided directly by the original equipment manufacturer ("OEM" or "Manufacturer"). All aspects of this warranty, including its terms, duration, coverage, limitations, exclusions, and the process for making a claim, are determined solely by the Manufacturer. Warranty documentation from the Manufacturer may accompany the equipment or be available directly from them.
NO WARRANTY FROM RE-BUY EQUIPMENT ENTERPRISES LLC: RE-BUY EQUIPMENT ENTERPRISES LLC acts as a reseller or distributor of this equipment and PROVIDES NO SEPARATE OR ADDITIONAL WARRANTY, EXPRESS OR IMPLIED. RE-BUY EQUIPMENT ENTERPRISES LLC specifically DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any 1 warranty protection for this equipment originates exclusively from the Manufacturer.
WARRANTY CLAIMS & SERVICE: Buyers must direct ALL warranty claims, requests for warranty service, defect reports, repairs, or replacements solely and directly to the Manufacturer according to the procedures outlined in the Manufacturer's warranty documentation. RE-BUY EQUIPMENT ENTERPRISES LLC is not responsible for fulfilling or administering the Manufacturer's warranty obligations and is not authorized to perform warranty service on behalf of the Manufacturer.
BUYER'S RESPONSIBILITY: The buyer is responsible for reviewing the Manufacturer's warranty documentation upon receipt, understanding its terms and conditions, registering the product with the Manufacturer if required, and following the Manufacturer's specified procedures for any warranty claims.
LIMITATION OF LIABILITY: RE-BUY EQUIPMENT ENTERPRISES LLC's liability in connection with the sale of this equipment is strictly limited. RE-BUY EQUIPMENT ENTERPRISES LLC shall not be liable for any failure of the Manufacturer to honor its warranty obligations. Furthermore, RE-BUY EQUIPMENT ENTERPRISES LLC shall not be liable for any damages arising from the equipment itself or the Manufacturer's warranty (or lack thereof), including direct, indirect, incidental, special, consequential, or punitive damages, beyond any remedies expressly provided to the buyer directly by the Manufacturer under their warranty terms.
